TERMS AND AGREEMENT

CODE COMPLIANCE : It is the responsibility of the applicant , building owner, permit holder, contractors, subcontractors and all persons performing work to comply with Lincoln County Fire Protection District #1 Ordinances and all adopted provisions contained therein. All work shall be in compliance with the ordinance in effect at time of permit issuance.

INSPECTION(S) are required. The permit holder (applicant) shall contact the Fire District at least 24 hours in advance to schedule the required inspections prior to opening for business. All retail sales location must have an approved inspection prior to selling.

GENERAL REQUIREMENTS:

Your Missouri Retail Sales License must be displayed at your sales location.
Your Lincoln County Fire Permit must be displayed at your sales location.
Only consumer fireworks UN0336, 1.4G are permitted.

FIRE EXTINGUISHERS:

Minimum of 2 (2A Rating) ABC Rechargeable fire extinguishers
Minimum of 1 (2.5 gallon) pressurized water extinguisher.
All extinguishers must be property inspected, tagged and current.
Maximum travel distance to any extinguisher is 35 feet.
All extinguishers must be easily accessible.
All employees must be trained in extinguisher operation. Approved documentation is required. The fire district can provide extinguisher training, however ALL employees must be present. There are no exceptions.

SITE REQUIREMENTS:

Certificate or other evidence verifying tent fabric as fire retardant
No hay, straw or shavings permitted.
30 foot area around site clear of dry grass, brush and combustible debris. Grass must be cut.
Fireworks not displayed behind glass.
Fireworks out of reach of public when attendant is not on duty.
Parking barriers are in place to prevent parking within 10 feet of tent/building.
No storage trailers within 10 feet of tent/building.
Tent/building is at least 20 feet from other buildings, cooking equipment, etc.
Generators are at least 20 feet from the tent/building.
Tent/building is at least 50 feet from gasoline pumps, filling stations, propane storage.

FIREWORKS DISCHARGE:

Fireworks shall not be discharged within 100 feet of the tent/building.
At least one sign must be posted: "NO FIREWORKS DISCHARGE WITHIN 100 FEET", minimum 4" high letters.

NO SMOKING SIGNS:

At least one sign with 4" letters at each entrance: "FIREWORKS NO SMOKING"
No smoking permitted in the tent/building or within 25 feet.

MEANS OF EGRESS:

Minimum of 2 remote means of egress free of obstructions. Two exits on the same end of tent are not considered remote.
Minimum clear isle width of 4 feet throughout.
Tent exit opening must be at least 44" in clear width.
All fireworks not within 2 feet of any entrance or exit.

EMERGENCY LIGHTING & EXIT SIGNS:

Exit signs to be self luminous or illuminated if open after dark.
Emergency lighting required if open after dark.

ELECTRICAL EQUIPMENT:

Electrical system and equipment isolated from the public.
All electrical wiring and equipment must be UL approved and installed and maintained to prevent electrical hazards.
All circuits must be protected by GFCI.

PROHIBITED ACTIVITY/ITEMS:

Sleeping inside tent/building is prohibited at all times.
Persons under 16 y/o are prohibited from selling fireworks unless under supervision of another who is at least 18 years of age.
Storage and display of pest control devices are prohibited.
Electronic pest control devices are prohibited inside sales location.
Alcoholic beverages are prohibited during business hours.
Proximate and display fireworks not sold with 1.4G fireworks.

The Permit Fee is $1,250 per retail sales location. This fee must be submitted to Lincoln County Fire Protection District at 700 E. Cherry St. Troy, MO 63379 before this Permit Application can be processed. Please make checks payable to "Lincoln County Fire".
